The Judicial Code of Panama

Our Judicial Code brings together or groups all the norms that regulate everything concerning the organization and functioning of the judiciary in the Republic of Panama. It is currently composed of three books, which in turn are subdivided, covering from the administration of justice to civil procedures and, lastly, the institutions of guarantee. In previous updates, this code included four books, with the last one being removed from this compendium and referring to criminal action and its procedure, until it was collected in a single text known today as the Code of Criminal Procedure. The importance of the Judicial Code lies in its precise procedural mechanism and serves as a guide for multiple processes in other areas, helping to resolve gaps in the exercise of judicial action.

Structure of the Judicial Code of Panama

As we explained briefly, the Judicial Code of Panama is divided into three main books:

Book One: Judicial Organization

This section focuses on the administration of justice, judicial appointments, the responsibilities and powers of various judicial bodies, the duties and responsibilities of magistrates and judges, jurisdiction and competence, the judicial career, the Public Prosecutor's Office, the Institute of Public Defense, and judicial ethics.

Book Two: Civil Procedure

This book addresses procedures related to civil actions, including proceedings, precautionary measures, parties involved, the subject matter of the process, incident management, evidence, judicial decisions, expenses and costs, exceptional means of terminating the process, appeals and consultations, and civil processes.

This book includes all the provisions related to institutions that provide procedural guarantees and uphold the rights of individuals involved in legal proceedings.
